Pre-nuptial Agreements
As the average age for marriage increases and those entering marriage or civil partnerships are likely to have accrued considerable assets before they take the plunge so it makes sense to agree on what should happen if you need to be dividing up those assets at a later stage. It might not be the most romantic part of your plans but a pre-nuptial agreement could save heartache later on
The main reason why pre-nuptial contracts have not been not more common in England and Wales is that, strictly speaking, they are not binding. However in a growing number of cases the courts now accept that in a situation where the parties have a properly drawn up pre nuptial agreement its contents should be given weight. As the length of an average marriage is continuing to decrease the pre-nuptial agreement is likely to assume greater significance.
If you are planning to marry, and particularly where you hold assets which you might wish to preserve if the marriage breaks down, it may be sensible to seek advice on the steps you can take to protect your position. An agreement will commonly make provision that the parties each retain any property respectively owned before marriage and deal with what will happen to property such as a home purchased for joint occupation.
Even where you decide a pre-nup is not for you it, it can be sensible as part of your wedding plans to take legal advice on what will happen if one of you dies, for example to jointly owned property. A simple Will may ensure your intentions are met.

What our Clients say
“Dear Grant,
I wanted to take this time to express my gratitude towards yourself and Jack for the fantastic work you have produced on a shareholder’s agreement for our company, Howha PMI Limited.
We knew we needed a shareholder’s agreement, however, whilst we are experts in the Private Medical Insurance (PMI) field, I would say we are rather uneducated when it comes to shareholders’ agreements. Therefore, we wanted professional advice from someone who would explain the agreement, and process in plain English. Something I’m pleased to say both you and Jack achieved.
During the process we had to change the goal posts and AMD took this in their stride. We believe any company who have multiple directors should have a shareholder’s agreement in place and any company looking for one, should be contacting AMD Solicitors to set it up.
Thank you once again for your time and expertise.”

Specifically, I wanted to acknowledge the following; Positive attitude, responsiveness, and clarity at the stage when I was calling around to choose a conveyancer (making the choice of solicitor easy). That first contact set the high-quality tone for all my interactions with AMD.
There were many ups and downs during the purchase of my new house, and my appointed solicitor helped me stay calm and always had clarity on what we should do next.
I would highly recommend AMD.”

07/12/2023“Thank you to Grant McCall, Laura Lynn and AMD Solicitors for the conveyancing work you recently carried out for the purchase of our house.
Your team were incredibly efficient and quick to get the process started, and as first time buyers who hadn’t been through the process before, were consistently patient and helpful in answering our numerous questions. Likewise, we were also very grateful for the advice and guidance Laura and her team gave to us about matters which we otherwise wouldn’t have considered or even known about.
As testament to the service provided the sale went through without any issues, and we have been very happily living there since, the perfect home for my wife and I and our small baby who arrived a short time after completion.
Since moving in, I have recommended AMD to a number of other friends, all of whom have been equally impressed with your service, and I will continue to do so. I look forward to working with yourself and AMD for all of our family matters over the years.”
